Run Falmouth with Runkeeper (#RunFalmouthWithRunkeeper) Social Media Campaign
Terms and Conditions

The #RunFalmouthWithRunkeeper Campaign (the “Campaign”) is a social campaign conducted in association with your participation in the ASICS Falmouth Road Race (the ”Race”) provided by/sponsored by ASICS Runner App., Inc. D/b/a Runkeeper (“Runkeeper” or “ASICS Runkeeper”).
Duration:
The Campaign will run from the 1st of July 2022 00:01 (ET) to 25th of August, 2022 23:59 (ET) (the “Campaign Period”).
Entry:
The Campaign is open to all individuals (excluding Directors, officers, management, employees, other staff and the immediate family and household members of those individuals of ASICS, ASICS offices in the participant countries, sales force, agencies involved in the development of the Race, affiliated companies and other persons involved in the Race) who are residents of USA including forty nine (49) of the fifty (50) states of the United States and the District of Columbia (void in Puerto Rico, all U.S. territories and possessions and all overseas military installations) at least 18 years of age or the age of majority in such individual’s state or country of residence, whichever is older, who entered the Campaign prior to the end of the Campaign Period (defined below).
Your entry to the Campaign will be automatic after you enter the Campaign during the Campaign Period, so long as you meet all the entry criteria. . One (1) entry per entrant.
ALTERNATIVE MEANS OF ENTRY: You may also enter the Sweepstakes by sending a 3x5 note card in a properly stamped envelope addressed to: ASICS Runner App, Inc., 125 Summer Street, Fl. 2, Boston, MA 02111, which includes your name, e-mail address, telephone number and the subject line ASICS’ "Run Falmouth with Runkeeper Campaign” Sweepstakes (“Mail-In Entry[ies]”). Mail-In Entries must be received by 28/08/2022 23:59 ET) to be included within the random drawing. Illegible, late, lost, incomplete, or garbled entries are not eligible. Mail-In Entries will be deemed submitted by the individual whose name is included on the Mail-In Entry.
Prizes:
One (1) Winner will be randomly selected by ASICS Runkeeper employees via software, from all valid entries and once verified will be awarded one (1) pair of ASICS sneakers with an ARV up to $200 USD. ASICS Runkeeper reserves the right to adjust the prize at its sole discretion, provided any changes made will result in a Prize of equal or greater value. Prize will be messengered or shipped, as determined by ASICS Runkeeper to an address provided by Winner.
Any expenses not specifically mentioned herein are not included as part of the Prize, and are solely the Winner’s responsibility. All taxes or fees on the Prize, if any, are the sole responsibility of the Winner, (the Winner will receive a form 1099 reflecting the actual value of the Prize received, if applicable). The Winner bears all risk of loss or damage to Prize after it released to Winner or after it is placed by ASICS Runkeeper with a third party common carrier for shipment to Winner. Prize will not be replaced if lost or stolen and is not redeemable for cash, unless required by law. No substitution allowed, except at ASICS Runkeeper’s sole discretion, a prize of equal or greater value may be substituted.
General Terms and Conditions:
1. The Campaign is administered by ASICS Runkeeper with its offices at 125 Summer St, Boston, MA 02110, United States.
2. The Campaign period runs from 01/07/22 0:00 (time zone) to 27/08/22 23:59 (time zone) (the “Campaign Period”). Entries, must be received during the Campaign Period to be validly included in the raffle.
3. Participants must be at least 18 years old or the age of majority in such individual’s state or country of residence, whichever is older, at the time of entry into the raffle.
4. Participant's must enter the Campaign by posting a photot to their Instagram feed and use #RunFalmouthWithRunkeeper. Participants Instagram profile must be pubblic in order to be entered. The Campaign participation is free. Once the posting is completed, entry to the Campaign is automatic. No purchase is necessary to enter or win the raffle.
5. Winners will be randomly selected by ASICS Runkeeper employees via software from all eligible entries received before the end of the Campaign Period.
6. Any entry not complying with these Campaign Rules is invalid. ASICS Runkeeper explicitly reserves the right to refuse or remove a submission of an entry, at its sole discretion, in the event ASICS Runkeeper determines the Participant does not comply with all Campaign Rules.
7. ASICS Runkeeper will contact the Winner by 31/08/22, about the raffle draw, via the Instagram account used to enter the campaign and ask to provide a valid mailing address for the sole purpose of delivering the Prize. The Winner will need to confirm the acceptance of the Prize and provide the mailing address, in writing, via email, to the initial contact within seven (7) working days to confirm the acceptance of the Prize. In the event that ASICS Runkeeper cannot for any reason get in contact with a winner, or a winner rejects or does not confirm its acceptance or provide the mailing address, in writing, via email, to the initial communications within seven (7) working days, ASICS Runkeeper reserves the right to select another winner by means of same winner selection process.
8. In case the Winner rejects the Prize after the acceptance, he or she shall bear any administrative costs incurred by ASICS Runkeeper and the cancellation fees / change of name fees. For the avoidance of doubt, there are no cash or any other alternative.
9. In ASICS Runkeeper’s sole discretion, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: (1) a potential Winner’s failure to respond to notification promptly upon receipt; (2) a potential Winner’s failure to provide ASICS Runkeeper with satisfactory proof of age, identity and residency; and (3) any other non-compliance with the Campaign Rules.
10. No cash redemptions or Prize substitutions allowed. The Prizes, or any unused portion thereof, cannot be returned, are non-transferable or exchangeable and cannot be taken as cash.
11. If for any reason any aspect of the Campaign event is not capable of running as planned, including by reason of infection by computer virus, telephone network failure, bugs, tampering, unauthorized intervention, fraud, technical failures or any cause beyond the control of ASICS Runkeeper, ASICS Runkeeper reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes, or invalidate any affected entries, subject to the approval of the relevant government authorities, if required.
12. ASICS Runkeeper reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or operation of ASICS Runkeeper or to be acting in violation of these Campaign Rules or in an unsportsmanlike or disruptive manner or entering or attempting to enter the Campaign multiple times through the use of multiple e-mail addresses or the use of any robotic or automated devices to submit entries.
13. ASICS Runkeeper’s decisions as to the administration and operation of the Campaign and the selection of the potential winners are final and binding in all matters related to the Campaign and are not open for discussion with ASICS Runkeeper.
14. ASICS Runkeeper (including its group companies, their officers, directors, employees and agents) shall not be liable (including for negligence) for any personal injury or any loss or damage otherwise arising out of or in connection, directly or indirectly, with this Campaign, the Prize(s) or technical difficulties or equipment malfunction (whether or not under ASICS Runkeeper’s control).
15. Except for any liability that cannot be excluded by law, by participating in the Campaign, all participants agree to release and hold harmless ASICS Runkeeper, its subsidiaries, affiliates, partners, agents, successors, assigns, each of their officers, directors, employees and agents, from and against any claim or cause of action, including, but not limited to, (a) Prize claims that contain inaccurate information or do not comply with or violate these Camapaign Rules; (b) Prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) participants who have committed fraud or deception in entering or participating in the raffle or claiming the Prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the participant to accept the Prize for any reason; (f) if a Prize cannot be awarded due to cancellation, delays or interruptions due to Act of God, natural disasters, terrorism, pandemic, weather or any other similar event beyond ASICS Runkeeper’s reasonable control; or (g) any damages, injuries or losses of any kind caused by the Prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of the Prize or resulting from participating in the Campaign or prize related activities.
16. ASICS Runkeeper will not respond to any inquiries regarding individual’s Campaign status or result. In case of any other inquiries or complaints about the raffle , please send an email to Marketing@Runkeeper.com.
17. ASICS Runkeeper reserves the right to modify these Campaign Rules at any time without prior notice for the sole purpose of ensuring the good execution of the Campaign, with no detrimental effect on the participants.
18. These Campaign Rules shall be governed by and be interpreted in accordance with the laws of Massachusetts and any disputes arising out of the Campaign shall be subject to the exclusive jurisdiction of the District Court of Boston, Massachusetts.

What personal information do we collect for the Sweepstakes?
ASICS Runkeeper collects your personal information for the purpose of running the Campaign. Personal information ASICS Runkeeper collects from you who entered the Sweepstakes includes your name, your gender, your address, your telephone number and your email address.
