Terms and Conditions

The Toronto 1 Hour Challenge (the “Challenge”) is a virtual challenge conducted in association with your participation in the TCS Toronto Waterfront Marathon (the ”Race”) provided by/sponsored by ASICS Runner App, Inc. d/b/a Runkeeper (“Runkeeper” or “ASICS Runkeeper”).
Duration:
The Challenge will run from the 4th of October 2022 00:01 (ET) to 10th of October, 2022 23:59 (ET) (the “Challenge Period”). It can be entered online through https://raceroster.com/dashboard/event-organizers/event/64535/event-info
Entry:
The Challenge is open to all individuals (excluding Directors, officers, management, employees, other staff and the immediate family and household members of those individuals of ASICS, ASICS offices in the participant countries, sales force, agencies involved in the development of the Race, affiliated companies and other persons involved in the Race) who are residents of Canada and at least 18 years of age or the age of majority in such individual’s state or country of residence, whichever is older, who completed the Challenge prior to the end of the Challenge Period (defined below). Entry into the sweepstakes is only open to participants of the Race, should you not be participating in the Race, you will not be eligible to be the winner of the sweepstakes, but are still able to participate in the challenges.
Your entry to the sweepstakes will be automatic after you complete the Challenge during the Challenge Period. One (1) entry per entrant.
Prizes:
One (1) Winner will be randomly selected by ASICS Runkeeper employees via software, from all valid entries and once verified will be awarded one (1) Garmin running watch (ARV $180 CAD), (1) pair of ASICS running shoes (ARV $220 CAD), and (1) VIP entry for race day (ARV $50 CAD). Prize will be messengered or shipped, as determined by ASICS Runkeeper to an address provided by Winner.
Any expenses not specifically mentioned herein are not included as part of the Prize, and are solely the Winner’s responsibility. All taxes or fees on the Prize, if any, are the sole responsibility of the Winner. The Winner bears all risk of loss or damage to Prize after it is released to Winner or after it is placed by ASICS Runkeeper with a third party common carrier for shipment to Winner. Prize will not be replaced if lost or stolen and is not redeemable for cash, unless required by law. No substitution allowed, except at ASICS Runkeeper’s sole discretion, a prize of equal or greater value may be substituted.
General Terms and Conditions:
1. The Challenge is administered by ASICS Runner App., Inc. d/b/a Runkeeper with its offices at 125 Summer St, Boston, MA 02110, United States.
2. The Challenge period runs from 10/04/22 0:00 (ET) to 10/10/22 23:59 (ET) (the “Challenge Period”). Entries must be received during the Challenge Period to be validly included in the Challenge.
3. Participants must be at least 18 years old or the age of majority in such individual’s state or country of residence, whichever is older, at the time of entry into the Sweepstakes.
4. Participant's must enter the Challenge via Race Roster. The Challenge participation is free. Once the Challenge is completed, entry to the sweepstakes is automatic. Registration for the Race is necessary to enter and win the sweepstakes.
5. If entering the Challenge via Race Roster, the Challenge must be completed during the Challenge Period. Winners will be randomly selected by ASICS Runkeeper employees via software from all eligible entries received before the end of the Challenge Period.
6. Any entry not complying with these Challenge Rules is invalid. ASICS Runkeeper explicitly reserves the right to refuse or remove a submission of an entry, at its sole discretion, in the event ASICS Runkeeper determines the Participant does not comply with all Challenge Rules.
7. ASICS Runkeeper will contact the Winner by 13/10/22, via the email address provided for the Challenge entry and ask to provide a valid mailing address for the sole purpose of delivering the Prize. The Winner will need to confirm the acceptance of the Prize and provide the mailing address, in writing, via email, to the initial contact within twenty-four (24) hours to confirm the acceptance of the Prize. In the event that ASICS Runkeeper cannot for any reason get in contact with a winner, or a winner rejects or does not confirm its acceptance or provide the mailing address, in writing, via email, to the initial communications within twenty-four (24) hours, ASICS Runkeeper reserves the right to select another winner by means of same winner selection process.
8. In case the Winner rejects the Prize after the acceptance, he or she shall bear any administrative costs incurred by ASICS Runkeeper and the cancellation fees / change of name fees. For the avoidance of doubt, there are no cash or any other alternative.
9. In ASICS Runkeeper’s sole discretion, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: (1) a potential Winner’s failure to respond to notification promptly upon receipt; (2) a potential Winner’s failure to provide ASICS Runkeeper with satisfactory proof of age, identity and residency; and (3) any other non-compliance with the Challenge Rules.
10. No cash redemptions or Prize substitutions allowed. The Prizes, or any unused portion thereof, cannot be returned, are non-transferable or exchangeable and cannot be taken as cash.
11. If for any reason any aspect of the Challenges event is not capable of running as planned, including by reason of infection by computer virus, telephone network failure, bugs, tampering, unauthorized intervention, fraud, technical failures or any cause beyond the control of ASICS Runkeeper, ASICS Runkeeper reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes, or invalidate any affected entries, subject to the approval of the relevant government authorities, if required.
12. ASICS Runkeeper reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or operation of ASICS Runkeeper or to be acting in violation of these Challenge Rules or in an unsportsmanlike or disruptive manner or entering or attempting to enter the Challenge multiple times through the use of multiple e-mail addresses or the use of any robotic or automated devices to submit entries.
13. ASICS Runkeeper’s decisions as to the administration and operation of the Challenge and the selection of the potential winners are final and binding in all matters related to the Challenge and are not open for discussion with ASICS Runkeeper.
14. ASICS Runkeeper (including its group companies, their officers, directors, employees and agents) shall not be liable (including for negligence) for any personal injury or any loss or damage otherwise arising out of or in connection, directly or indirectly, with this Challenge, the Prize(s) or technical difficulties or equipment malfunction (whether or not under ASICS Runkeeper’s control).
15. Except for any liability that cannot be excluded by law, by participating in the Challenge, all participants agree to release and hold harmless ASICS Runkeeper, its subsidiaries, parents, affiliates, partners, agents, successors, assigns, each of their officers, directors, employees and agents, from and against any claim or cause of action, including, but not limited to, (a) Prize claims that contain inaccurate information or do not comply with or violate these Challenge Rules; (b) Prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) participants who have committed fraud or deception in entering or participating in the Sweepstakes or claiming the Prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the participant to accept the Prize for any reason; (f) if a Prize cannot be awarded due to cancellation, delays or interruptions due to Act of God, natural disasters, terrorism, pandemic, weather or any other similar event beyond ASICS Runkeeper’s reasonable control; or (g) any damages, injuries or losses of any kind caused by the Prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of the Prize or resulting from participating in the Challenge or prize related activities.
16. ASICS Runkeeper will not respond to any inquiries regarding individual’s Challenge status or result. In case of any other inquiries or complaints about the Sweepstakes, please send an email to Marketing@Runkeeper.com.
17. ASICS Runkeeper reserves the right to modify these Challenge Rules at any time without prior notice for the sole purpose of ensuring the good execution of the Challenge, with no detrimental effect on the participants.
18. These Challenge Rules shall be governed by and be interpreted in accordance with the laws of Massachusetts and any disputes arising out of the Challenge shall be subject to the exclusive jurisdiction of the District Court of Boston, Massachusetts.

What personal information do we collect for the Raffle?
ASICS Runkeeper collects your personal information for the purpose of running the Challenge. Personal information ASICS Runkeeper collects from you who entered the raffle includes your name, your gender, your address, your telephone number and your email address.
