ASICS Tokyo Marathon Challenges Sweepstakes (the “Sweepstakes”)

The ASICS Tokyo Marathon Challenges (the “Challenge”) is a virtual challenge conducted by/sponsored by ASICS Corporation and ASICS Runner App, Inc. d/b/a Runkeeper (“Runkeeper” or “ASICS ”).

The Challenge consists of three mini challenges (3K, 5K, 10K activities) for participants to complete, in order to be eligible for the Sweepstakes.

These terms and conditions ("Terms and Conditions") apply to the Sweepstakes. By submitting an entry to the Sweepstakes, you are deemed to have read and understood these Terms and Conditions and agree to be bound by them.

DURATION:

The Sweepstakes will run from October 28th, 2022 00:00 (CET) to November 10th , 2022 23:59 (CET) (the “Sweepstakes Period”).

ENTRY:

The Sweepstakes is open to all existing OneASICS members (excluding Directors, officers, management, employees, other staff and immediate family and household members of those individuals of ASICS or ASICS offices in the participant countries) who are residents of The United Kingdom and Ireland, and at the time of entry are at least 18 years of age.

To enter, ruring the Sweepstakes Period, the participant must:

(1) click on a social ad or email promoting the Challenge.

(2) complete the Challenge registration on Race Roster.

(a) During registration, participant must sign into their OneASICS account or create a new one if they don’t have one.

(b) During registration, participant must login to Runkeeper using their OneASICS account .

(5) Complete 1, 2 or 3 Challenge activities (each, a “Mini Challenge”) in Runkeeper. For each Mini Challenge the participant completes, they will receive the chance to submit another entry to win a bib for Tokyo Marathon 2023. The maximum number of entrants a participant can submit is 3.

Participation is free. Your entry to the Sweepstakes will be automatic after you complete the mini Challenge during the Sweepstakes Period.

PRIZE:

Two winners will be randomly selected by ASICS employees via software, from all valid entries and once verified the winners will be awarded two entries (1 for winner, 1 for a friend) to the 2023 Tokyo Marathon taking place on March 5, 2023.

The winner will also receive:

  • roundtrip economy class airfare from either London or Dublin to Tokyo (note the flights may be indirect)
  • Four nights in a four star accomodation in a shared double or twin room (shared between winner and a friend). Breakfast included. Hotel locations and dates are subject to availability.
  • Comprehensive travel insurance is included in the prize package for those aged up to and including 69 years. This excludes cover for pre-existing medical conditions.
  • The Winner and friend will each receive fifty GBP to assist with bus or train transport from the airport in Tokyo to the hotel. Travel to and from the airport in the UK or Ireland is at the Winner’s expense.

The total retail value of the prize is £3,200.00 per prize (for two people travelling).

The winner will be notified via email to the email address associated with their OneASICS account. The email will contain instructions on how to accept the Prize. The winners will be notified on or before November 24, 2022, if notified you have 3 business days to accept, otherwise ASICS will reselect another Winner. If you do not receive an email indicating you are the winner, you did not win.

Any expenses not expressly mentioned herein are not included as part of the Prize and are solely each Winner’s responsibility. All taxes (including any applicable local tourist or city tax) or fees (including pre-booked seats together on the flight if desired)on the Prize, if any, are the sole responsibility of each Winner.

The accompanying friend must also meet the requirements set out by these terms and conditions and any other applicable rules or regulations, such as those set by the airlines.

Each Winner bears all risk of loss or damage to Prize after it released to Winner or after it is placed by ASICS with a third party common carrier for shipment to Winner. Prize will not be replaced if lost or stolen and is not redeemable for cash, unless required by law. No substitution allowed, except at ASICS’ sole discretion.

The Winner is aware that accepting the prize and participating in the prize, is subject to the additional terms and conditions, such as that of the airline, hotel, Tokyo Marathon, and any travel agency or booking service. These terms and conditions can be made available once the bookings are confirmed.

General Terms and Conditions:

  1. The Sweepstakes is administered by ASICS Corporationand ASICS Runner App, Inc. d/b/a Runkeeper, 125 Summer Street, Fl. 2, Boston, MA 02111 (“Runkeeper” or “ASICS Runkeeper”).
  2. The Sweepstakes period runs from October 28h, 2022 00:00 (CET) to November 10th, 2022 23:59 (CET) (the “Sweepstakes Period”). Entries, must be received during the Sweepstakes Period to be validly included in the Sweepstakes.
  3. Participants must be at least 18 years old or the age of majority in such individual’s state or country of residence (please see the list of countries above), whichever is older, at the time of entry into the Sweepstakes.
  4. Any entry not complying with these Sweepstakes Rules is invalid. ASICS explicitly reserves the right to refuse or remove a submission of an entry, at its sole discretion, in the event ASICS determines the Participant does not comply with all Sweepstakes Rules.
  5. ASICS or its regional ASICS entity will contact the Winners by November 24, 2022, about the prize draw, via the email address associated with your OneASICS account. In the event that ASICS cannot for any reason get in contact with a winner, or a winner rejects or does not confirm its acceptance or provide the required information, in writing, via email, to the initial communications within three (3) working days, ASICS reserves the right to select another winner by means of same winner selection process. The selection of another winner shall be up to three winners per bib, after that the draw closes. In the case that the winner does not claim the prize within three (3) working days, they lose the right to the prize and ASICS owes no compensation to the winners.
  6. In case the Winner rejects the Prize after acceptance, he or she shall bear any administrative costs incurred by ASICS in relation to cancellation fees / change of name fees or other direct cost. For the avoidance of doubt, there is no cash or any other alternative to prize.
  7. In ASICS’ sole discretion, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: (1) a potential Winner’s failure to respond to notification promptly upon receipt; (2) a potential Winner’s failure to provide ASICS with satisfactory proof of age, identity and residency; and (3) any other non-compliance with the Sweepstakes Rules.
  8. No cash redemptions or Prize substitutions allowed. The Prizes, or any unused portion thereof, cannot be returned, are non-transferable or exchangeable and cannot be taken as cash.
  9. If for any reason any aspect of the Sweepstakes event is not capable of running as planned, including by reason of infection by computer virus, telephone network failure, bugs, tampering, unauthorized intervention, fraud, technical failures or any cause beyond the control of ASICS, ASICS reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes, or invalidate any affected entries, subject to the approval of the relevant government authorities, if required.
  10. ASICS reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or operation of ASICS or to be acting in violation of these Sweepstakes Rules or in an unsportsmanlike or disruptive manner or entering or attempting to enter the Sweepstakes multiple times through the use of multiple e-mail addresses or the use of any robotic or automated devices to submit entries.
  11. ASICS’ decisions as to the administration and operation of the Sweepstakes and the selection of the potential winners are final and binding in all matters related to the Sweepstakes and are not open for discussion with ASICS.
  12. ASICS (including its group companies, their officers, directors, employees and agents) shall not be liable (including for negligence) for any personal injury or any loss or damage otherwise arising out of or in connection, directly or indirectly, with this Sweepstakes, the Prize(s), or technical difficulties or equipment malfunction (whether or not under ASICS’s control).
  13. Except for any liability that cannot be excluded by law, by participating in the Sweepstakes and/or the Prize, all participants agree to release and hold harmless ASICS, its subsidiaries, affiliates, partners, agents, successors, assigns, each of their officers, directors, employees and agents, from and against any claim or cause of action, including, but not limited to, (a) Prize claims that contain inaccurate information or do not comply with or violate these Sweepstakes Rules; (b) Prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) participants who have committed fraud or deception in entering or participating in the Sweepstakes or claiming the Prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the participant to accept the Prize for any reason; (f) if a Prize cannot be awarded due to cancellation, delays or interruptions due to Act of God, natural disasters, terrorism, pandemic, weather or any other similar event beyond ASICS’s reasonable control; or (g) any damages, injuries or losses of any kind caused by the Prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of the Prize or resulting from participating in the Sweepstakes or prize related activities.
  14. ASICS will not respond to any inquiries regarding individual’s Sweepstakes status or result. In case of any other inquiries or complaints about the Sweepstakes, please send an email to ecom-info-eu@asics.com. Note that if you have not been contacted by ASICS on or before November 24, 2022, you are not a Winner.
  15. ASICS reserves the right to modify these Sweepstakes Rules at any time without prior notice for the sole purpose of ensuring the good execution of the Sweepstakes, with no detrimental effect on the participants. Participants will have the right to withdraw from the Sweepstakes if material amendment is made, however an exchange or substitution of the prize will not be granted in the case that a Winner decides to withdraw.
  16. These Sweepstakes Rules shall be governed by and be interpreted in accordance with the laws of Massachusetts and any disputes arising out of the Sweepstakes shall be subject to the exclusive jurisdiction of the District Court of Boston, MA.

ASICS collects your personal information for the purpose of running the Sweepstakes. Personal information ASICS collects from you includes your name, your gender, your address, your telephone number and your email address.
