GMS Queen City Marathon 2023 - Expo Registration

September 8th - 10th, 2023

  1. The Queen City Marathon Inc (hereinafter referred to as, “the Marathon”) and the Exhibitor agrees to the following terms and conditions for the 2023 Queen City Marathon Wellness Expo & Runners Market (hereinafter referred to as, “the Expo).
  2. The Expo is located at the Conexus Arts Centre, 200A Lakeshore Drive, Regina, Saskatchewan (https://goo.gl/maps/jhsrp).
  3. The Exhibitor agrees that all displays will be fully set up by Friday, September 8, 2023 at 11:00 am. Set up time is open Thursday, September 7, 2023, 11:00 am to 5:00 pm and Friday, September 8, 2023, 8:30 am to 10:30 am.
  4. The Exhibitor agrees to have their booth open and staffed during the Expo hours on Friday, September 8, 2023, 11:00 am to 7:30 pm and Saturday, September 9, 2023, 8:30 am to 5:30 pm. Take down of booth may not begin prior to 5:30 pm, Saturday, September 9, 2023.
  5. The Exhibitor may not use the name GMS Queen City Marathon, its logo or copyrights for any commercial purpose or any merchandise without written consent from the Marathon
  6. The Exhibitor agrees that displays will not visually or physically disturb aisles or adjacent exhibitors.
  7. The Exhibitor agrees to conform to all rules and regulations adopted by the Marathon in the best interest of the Marathon, and agree that the Marathon shall have final decision in adopting any rule or regulation deemed necessary prior to, during and after the Expo.
  8. The Exhibitor agrees to not sublet space or exhibit any merchandise, other than that approved by the Marathon, without permission of the Marathon.
  9. The Exhibitor agrees that all literature, products, etc. belonging to the Exhibitor shall be removed from the Expo by Saturday, September 9, 2023 at 8:00 pm unless approved otherwise by the Marathon in writing.
  10. The Exhibitor agrees that the violation of any terms and conditions of the Agreement may result in forfeiture of the booth. Fees paid by the Exhibitor will be retained by the Marathon as liquidated damages for breach of this Agreement.
  11. The Exhibitor agrees that the Marathon reserves the right to restrict or reject any exhibit.
  12. The Exhibitor agrees to allow the Marathon to use photographs of the exhibits for its own purposes.
  13. The Exhibitor agrees not to cause damage to the site or booth equipment, or act in any manner deemed inappropriate by the Marathon. The Exhibitor agrees they shall be liable for all damages which they may cause to the site in connection with their exhibit. Exhibitors may not apply paint, lacquer, adhesive or other coatings to floors or to standard booth equipment without written permission of the Marathon.
  14. The Exhibitor agrees that the Marathon has the right to cancel the Expo at any time and has sole discretion to determine and refund to the Exhibitor the proportionate share of the balance of the total fees received which remains after deducting expenses incurred by the Marathon, but in no case shall the amount of the refund exceed the amount paid by the Exhibitor.
  15. The Exhibitor assumes entire responsibility and liability for losses. The Exhibitor’s property shall be placed on display and exhibited at their own risk, and the Marathon assumes no responsibility for loss or damage thereto. The Exhibitor shall also assume all responsibility for loss or damage to their property due to fire, theft, explosion, or any cause beyond the control of the Marathon.
  16. The Exhibitor understands that the Marathon does not maintain insurance covering the Exhibitor’s property or lost revenue, and it is the sole responsibility of the Exhibitor to obtain insurance for this risk.
  17. The Exhibitor hereby agrees to indemnify and hold harmless the Marathon from any claims arising as a result of the Exhibitor’s exhibit or any actions or conduct of the Exhibitor or the Exhibitor’s agents and employees, or the property of the Exhibitor.
  18. If the Exhibitor is participating at the Sunday Outdoor Race Site, the Exhibitor agrees to have their booth open and staffed on Sunday September 10, 2023 from 7:00 am to 2:00 pm. Take down of booth may not begin prior to 2:00 pm Sunday September 10, 2023 and removed from race site by 3:00 pm.
