2025 TCS SYDNEY MARATHON RUN CLUB TERMS AND CONDITIONS
I agree to the following as a condition of participating in a run club event endorsed by the Pont3 Pty Ltd, as part of the 2025 TCS Sydney Marathon (“Running Club”).
I acknowledge that these terms and conditions are between Pont3 Pty Ltd, the exclusive licensed promoter, and the Participant.
- I understand that exercise, training, and using fitness equipment are potentially hazardous activities. I further understand that the Activities involve risks of injury, aggravation of pre-existing conditions, and in the most severe and extreme situations, even severe or serious injury.
- I acknowledge that exercise on the body cannot be predicted with complete accuracy and that injuries may occur during or following exercise that could lead to these complications and adversely affect my health. These changes may include, among other effects, high blood pressure, increased heart rate, altered heart function, and possibly, and again in rare instances, cardiac complications. Accordingly, I acknowledge that I am voluntarily participating in the Activities with the full knowledge and understanding of the potential dangers.
- I further declare that I am physically fit, sound and suffering from no condition, impairment, disability, disease, infirmity, or illness that should prevent my participation in the Activities.
- In consideration of being allowed to join the Activities, I personally assume all risks involved in all exercising and training. I also waive and release, all claims and causes of action against Pont3 its elected or appointed officers, agents, volunteers, employees, representatives, consultants and all others directly or indirectly connected with the Activities from any and all personal injuries I sustain (including death), any medical condition of any kind which results, any aggravation of a pre-existing medical condition that I aggravate, and any and all other damages or injuries which I sustain in any way from the direct or indirect result of my activities, exercise, training and participation in the Activities.
- For good and valuable consideration of allowing me to join the Activities, I hereby grant Pont3 and its affiliates, agents and retailers permission to engage a photographer and videographer to photograph me and film me during the Activities.
- I further give my irrevocable consent (without fee) to Pont3 and their direct or indirect licensees and assignees to publish, republish or otherwise transmit the images of myself (taken during the Activities) in any medium for all purposes throughout the world. I understand that the images may be altered or modified in any manner.
- I hereby waive any right that I may have to inspect and approve a finished product or the copy that may be used in connection with an image Pont3 or Sydney Marathon has taken of me, or the use to which it may be applied.
- I am responsible for all property I bring to the Event sites and acknowledge that Pont3 Pty Ltd, accepts no responsibility for any loss or damage to this property.
Privacy Declaration: Pont3 collects uses and discloses personal information for the purposes of conducting and administrating the Sydney Marathon and other related activities, including for identifying participants, recording results, and communicating with you, and for providing you with member services or promotional material such as other events or sponsor offers and information. Pont3 collects, uses, and discloses personal information in accordance with Pont3's privacy policy. Pont3 may share your information with third parties as required, including but not limited to official sponsors of the event disclosing your personal information.
The Pont3 privacy policy contains information about how to access and correct personal information held by Pont3 or how to make a complaint about the handling of personal information. Applications or services may be rejected if requested information is not provided. Opt-out procedures are available for individuals wishing to avoid receipt of promotional material from Pont3 or third parties.
