TERMS & CONDITIONS
These Terms & Conditions (“Terms”) govern participation in the HKL Fun Run 2026 (“Event”).
By registering for the Event, each participant agrees to be bound by these Terms & Conditions.
1. Eligibility
1.1. The 5KM Run (Individual Category) is open to individuals aged twelve (12) years and
above as at the date of the Event.
1.2. The 3KM Run (Family Category) is open to participants aged five (5) years and above as at the date of the Event.
1.3. Participants below eighteen (18) years of age must obtain consent from a parent or legal guardian. The parent or legal guardian shall be deemed to have read, understood, and agreed to these Terms & Conditions on behalf of the minor.
1.4. The Organiser reserves the right to verify the age and identity of any participant at any time. Failure to provide satisfactory proof of age may result in disqualification without refund.
2. Registration & Confirmation
2.1. Registration is confirmed only upon full payment of the applicable registration fee and issuance of an official confirmation by the Organiser.
2.2. All registration fees are strictly non-refundable and non-transferable unless otherwise determined by the Organiser.
2.3. The Organiser reserves the right to refuse, cancel, or suspend any registration at its sole discretion without assigning any reason.
3. Event Amendments, Postponement or Cancellation
3.1. The Organiser reserves the right to amend Event details including but not limited to the Event date, venue, race routes, categories, entitlements, and programme schedule.
3.2. The Organiser reserves the right to postpone or cancel the Event without prior notice due to circumstances beyond its reasonable control, including but not limited to force majeure events such as haze, flood, pandemic, endemic, storm, inclement weather, acts of God, terrorism, civil unrest, governmental directives, or safety concerns.
3.3. In the event of cancellation due to force majeure, registration fees shall not be refunded unless otherwise decided at the sole discretion of the Organiser.
4. Run Kit Collection
4.1. Participants must collect their Run Kit during the designated collection period at the announced venue and time.
4.2. Run Kits may include a Race Bib, Event T-shirt, and other items as determined by the Organiser.
4.3. Participants must present their confirmation slip and/or NRIC (or valid identification document) for verification.
4.4. If unable to collect in person, a representative may collect on the participant’s behalf upon presentation of the required documentation.
4.5. Run Kits not collected within the stipulated period shall be deemed forfeited. No late collection or delivery will be entertained.
5. Fitness & Medical Condition
5.1. Participants warrant that they are medically fit and physically capable of participating in the Event.
5.2. Participants with pre-existing medical conditions are strongly advised to seek medical consultation prior to participation.
5.3. The Organiser shall not be liable for any injury, illness, accident, or mishap arising from participation in the Event or from non-disclosure of medical conditions.
6. Assumption of Risk & Release of Liability
6.1. Participation in the Event is entirely at the participant’s own risk.
6.2. Participants acknowledge that running events involve inherent risks including but not limited to injury, permanent disability, death, and property damage.
6.3. To the fullest extent permitted under the laws of Malaysia, participants release and discharge the Organiser, sponsors, partners, affiliates, employees, contractors, volunteers, and representatives from any claims, liabilities, losses, or damages arising out of or in connection with participation in the Event.
7. Indemnity
Participants agree to indemnify and hold harmless the Organiser and its associated parties against any claims, demands, liabilities, damages, costs, or expenses (including legal costs) arising from their participation in the Event or breach of these Terms.
8. Race Bib & Identification
8.1. Participants must wear their assigned Race Bib visibly on the front of their attire at all times during the Event.
8.2. Race Bibs are strictly non-transferable and must not be duplicated, altered, or exchanged.
8.3. Any participant found using an unauthorized or tampered Race Bib may be disqualified without refund.
9. Cut-Off Time & Route Closure
9.1. The Organiser reserves the right to impose cut-off times to ensure safety and compliance with road closure permits.
9.2. Participants who fail to complete the race within the stipulated cut-off time may be required to stop and/or be transported to the finish area.
9.3. The Organiser shall not be liable for any consequences arising from failure to meet the cut-off time.
10. Prohibited Items & Conduct
10.1. The following are prohibited on the race route unless otherwise approved:
• Pets or animals
• Bicycles, rollerblades, skateboards, scooters or similar devices
• Hazardous or dangerous items
10.2. Participants must comply with all instructions issued by Event officials and security personnel.
10.3. The Organiser reserves the right to remove or disqualify any participant whose conduct is deemed unsafe, disruptive, or contrary to the spirit of the Event.
11. Personal Data Protection
11.1. Participants consent to the collection and processing of personal data in accordance with the Personal Data Protection Act 2010 (Malaysia).
11.2. Personal data may be used for Event administration, communication, marketing, promotional purposes, and publication of race results.
11.3. The Organiser shall take reasonable steps to ensure personal data is handled securely in compliance with Malaysian law.
12. Photography & Publicity
Participants grant the Organiser the irrevocable and royalty-free right to use photographs, videos, recordings, or other media captured during the Event for promotional, marketing, and commercial purposes without compensation or further notice.
13. Refund Policy
13.1. Registration fees are strictly non-refundable if a participant chooses not to participate. 13.2. No refund shall be provided in the event of cancellation due to force majeure.
13.3. No refund shall be made in cases of disqualification due to breach of these Terms.
14. Prohibition on Transfers & Multiple Entries
14.1. Transfer of race entries to another person is strictly prohibited.
14.2. Changes to race categories after registration confirmation are strictly prohibited.
14.3. Each participant is permitted only one (1) registration. Multiple entries may result in disqualification without refund.
15. Event Entitlements
The Organiser reserves the right to substitute Event entitlements, including but not limited to T-shirts, medals, and goodie bags, with items of similar value without prior notice.
16. Amendment of Terms & Conditions
16.1. The Organiser reserves the right to amend, modify, update, or revise these Terms & Conditions at any time without prior notice.
16.2. Any amendments shall take effect upon publication on the official Event website or registration portal.
16.3. Continued registration and/or participation constitutes acceptance of the revised Terms.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable under Malaysian law, the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms & Conditions constitute the entire agreement between the participant and the Organiser and supersede all prior communications, representations, or agreements.
19. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with the Event shall be subject to the exclusive jurisdiction of the courts of Malaysia.
