Coway Run 2024 – Terms and Conditions
Please read the following terms and conditions ("Terms") carefully. Each individual who registers to participate in the Coway Run 2024: Run For Tomorrow, an on-ground marathon event (hereinafter referred to as the “Event"), and where applicable, in the case of a participant below the age of 18 years, the participant's parent, guardian or legal representative (each, a "Participant"), declares and acknowledges to have read, understood and agreed to the Terms and undertakes to comply with and be bound by the same.
1. The Event is organised by Coway (Malaysia) Sdn. Bhd. (the “Organiser”).
2. Details of the Event are as follows:
Date : 22nd September 2024
Start Time : 5:00 a.m.
Venue : Dataran Merdeka (Merdeka Square), Jalan Raja, City Centre, 50050 Kuala Lumpur, Wilayah Persekutuan Kuala Lumpur
3. Eligibility:
a. The Event is open to individuals aged 3 and above, and each Participant attends the Event on his or her own free will, subject to the following requirements:

b. For Participants aged 3 - 17 years old (“Minor Participants”) to be eligible for the Event, he/she must be accompanied by at least one Participant of 18 years old and above and present at all times as the guardian of the said Minor Participant(s).
c. For the avoidance of doubt, a Participant below the age of 18 years old is required to obtain his/her parent’s/legal guardian’s consent, failing which, the Organiser reserves the right to refuse entry to that Participant.
d. Notwithstanding the foregoing, the Organiser reserves the right to cancel and/or add any race category/distance options and change the eligibility criteria without prior notice to the Participants.
EVENT REGISTRATION
4. By signing up for the Event and providing any information, personal or otherwise (“Registration Data”) to the Organiser on the Event’s platform (the “Coway Run Website”), the Participant is deemed to have given explicit consent to the Organiser and its co-organisers, co-sponsors, partners, volunteers, and any entities or persons that provide products or services for the Event and the Event’s activities (“Affiliates”) to collect, process, store and retain his/her Registration Data (including the Participant’s personal data) for the purposes as they may deem fit, including without any limitation for the following purposes:
a. to register an account on the Coway Run Website;
b. to create, manage, and maintain the Participant’s account and his/her Runner Profile which contains the Participant’s details on the Coway Run Website;
c. to manage the Participant’s involvement/engagement in events and/or promotions hosted on the Coway Run Website, where he/she has signed up for such events and/or promotions;
d. to process payments made by the Participant or on the Participant’s behalf via the Organiser’s payment gateways operated by third-party service providers;
e. to enable the Participant to interact with other Participants/registrants of the Event;
f. to provide administrative notices or communications applicable to the Participant’s use of the Coway Run Website;
g. to manage and maintain the Organiser’s relationship with the Participant;
h. to keep the Participant informed of the Organiser’s products and/or services, promotions, discounts, and/or events;
i. to provide care and enhance customer satisfaction, including but not limited to: resolving complaints, dealing with and/or responding to the Participant’s requests, and enquiries related to the Event;
j. to operate, evaluate, and improve the business, and the products and services offered by the Organiser;
k. to analyse and enhance the Organiser’s marketing communications and strategies;
l. for internal record keeping or other administrative purposes;
m. for statistical analysis purposes;
n. for information management and security purposes, including but not limited to managing and administrating e-mails, handling and investigating any security-related issues, vulnerabilities, and/or incidents;
o. (upon conclusion of the Event) where there are outstanding obligations either on the Participant’s part or on the Organiser’s part;
p. to purchase Group Personal Accident Insurance on behalf of the Participant (as made mandatory by the Malaysian Sports Commissioner’s Office for every public sports event);
q. to exercise any functions conferred by law and/or towards the administration of justice; and/or
r. for and/or in connection with all other purposes incidental and/or ancillary to the Organiser’s business/services or in furtherance to any of the above-mentioned purposes.
5. In consideration of the Participant’s use of the Coway Run Website, the Participant agrees to:
a. provide true, accurate, current, and complete Registration Data;
b. maintain the security of the Participant’s password and identification; and
c. maintain and promptly update the Registration Data to keep it true, accurate, current, and complete.
6. The Organiser may contact the Participant from time to time by email and/or phone. Any notice sent to the email address and /or mobile device registered with the Organiser shall be deemed as received by the Participants.
7. If the Participant provides any Registration Data that is untrue, inaccurate, outdated, or incomplete, or the Organiser has reasonable grounds to suspect such information is untrue, inaccurate, outdated, or incomplete, the Organiser may suspend or terminate the Participant's registration and refuse any and all current or future use of any components of the Coway Run Website. There shall be no refund of any fees paid by the Participant upon such suspension or termination of the Participant's registration.
8. The Organiser will not entertain or be in any way responsible for any disputes arising from any incomplete or inaccurate Registration Data provided by the Participant on the Coway Run Website.
9. The Organiser shall in no event be held liable for any errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communications line failure, theft or destruction, unauthorised access to, or alteration of user communications, or any problems or technical malfunction of any telephone networks or lines, computer online systems, servers or providers, computer equipment, software, failure of email or traffic congestion on the internet and/or the Coway Run Website.
10. Once the Participant’s registration has been duly processed and the required payment is made, the Participant may collect the Event merchandise which consists of a bag, a Coway Run official t-shirt (measurements are subject to 0.79+/- inch tolerance), a numbered race bib (for 10KM and 21KM run only), a wristband (for 5KM run only) and a medal (collectively referred to as the “Coway Run Race Kit”). There will be no refunds made to any Participants who do not eventually take part in the Event for whatever reason.
11. All colours, designs, and materials of the Coway Run Race Kit are subject to change without any notice. In addition, the Organiser reserves the right to replace any merchandise in the Coway Run Race Kit with any other merchandise of the same value without any notice to the Participants.
EVENT PARTICIPATION
12. The Participant shall fully assume all risks associated with his/her participation in the Event, including any risks related to Minor Participants if the Participant is their guardian. These risks include, but in no way limited to any risks that may arise from negligence or carelessness on the part of the Organiser and its Affiliates, from dangerous or defective equipment or property owned, maintained, or controlled by the same. The Participant understands and acknowledges that the Organiser and its Affiliates provide no warranties regarding the Participant’s well-being and safety before, during or after the Event.
13. By participating in the Event, the Participant agrees that he/she is physically fit and has not been advised by a qualified medical professional to not participate in the Event. The Participant further certifies that there are no health-related reasons or issues which preclude his/her participation in the Event.
14. While the Organiser endeavours to ensure the safety of the Participants during the Event, to the extent permitted by law, the Organiser shall not be liable to any persons (whether the Participants or any third parties) for any losses or damages arising during the Event (including any travelling to and from the Event), whether or not the same is caused by or attributable to any acts or omissions on the part of the Organiser or its Affiliates. This shall include, but shall not be limited to:
i. any losses or damages to property;
ii. any death or personal injuries to any persons; or
iii. any indirect/consequential (including loss of income or profits), general, special, punitive, or contingent damages howsoever arising, whether in contract, tort (including negligence) or otherwise and even if the Organiser or its Affiliates have been advised of the possibility of such damages.
A. The Run
15. The Organiser reserves the right to refuse entry to any applicant under the age of 3 for the 5KM Run and under the age of 16 for the 10KM and 21KM Run. Notwithstanding the foregoing, the Organiser reserves the right to limit and/or refuse any Participant entry to the Run without giving any reason/notice.
16. The Participant must wear the assigned numbered race bib at all times during the Run. This requirement is applicable only to Participants in the 10KM and 21KM Run. The Organiser reserves the right to refuse entry to any non-compliant Participants.
17. The Participant shall comply with the rules and safety instructions provided to him/her by the Organiser and its Affiliates, at all times before, during, and after the Run.
18. It is the sole responsibility of every Participant to immediately inform the official medical staff/safety marshal of the Event if he/she is mentally or physically unfit; suffers any injury at any time during or immediately before the Run, or any other reasons that they have to withdraw from the Run.
19. In the event the Participant suffers any injuries or feels breathless or faint during the Run, he/she must immediately retire from the Run if required to do so by any member of the official medical staff/safety marshal.
20. The Participant further consents to receiving appropriate medical treatment that is deemed fit and advisable in the event of an illness, accident, or injury occurring during or at the Run.
21. For the avoidance of doubt, there shall be no refund of the fees if the Participant withdraws or retires from the Run due to any reason whatsoever.
22. The Participant shall be solely responsible for his/her belongings and property; and the Organiser and its Affiliates shall under no circumstances be held responsible for any lost, damaged, or stolen property caused by whatever reason during the Run.
23. The Organiser reserves the right to use any photographs (including those of the Participants), motion pictures, recordings, or any other media records of the Run (including any programme(s), event(s), talk(s), demonstration(s), or any other activities associated before, during or after the Run, for any legitimate purpose including but not limited to commercial advertising and publicity purposes, without any credit, payment, or any form of compensation to the Participants.
24. Prizes will only be given away for the 21KM and 10KM categories. There will be no prizes for the winners of the 5KM category. The winners of the 21KM and 10KM categories must be personally present at the Venue on the day of the Run to collect their prizes upon the announcement of the results. All uncollected prizes will be forfeited.
25. The Organiser reserves the right to request a sighting of the winners’ original identity card(s) or passport(s) for verification purposes.
B. Others
26. The Organiser reserves the ultimate right to amend the Terms which will be reflected on the Coway Run Website, and it is the responsibility of all Participants to keep abreast with any changes.
27. The Organiser reserves the right to make any changes to the Event’s Date, Venue or to cancel the Event (collectively referred to as “Event Changes”) at any time without prior notice to the Participants, in which case the Organiser will make every reasonable effort to inform the Participants prior to the Event Date. There shall be no refund of any fees paid and the Organiser shall not be held liable for any other losses or inconvenience caused to the Participants resulting from any of the Event Changes.
28. There will be no refund of the fees if the Event is cancelled for reasons of force majeure i.e. due to the occurrence of incidents that are beyond the Organiser’s control (including but not limited to haze, storm, rain, inclement weather, wind, acts of God, terrorism, movement control orders, or other conditions) and which in the Organiser's opinion, renders it impossible or unsafe to proceed with the Event.
29. Coway Run 2024’s Privacy Policy can be found at https://www.cowayrun.com.my/privacy-policy (“Privacy Policy”) and forms an integral part of the Terms. The Participant acknowledges that he/she has read and understood the Privacy Policy and agrees to the processing of the Participant’s personal data as set out therein. The Organiser may use reasonable efforts to bring any significant changes to the Privacy Policy to the Participant’s attention.
COWAY RUN 2024 – LUCKY DRAW EVENT TERMS AND CONDITIONS
Coway Run 2024 – Lucky Draw Event (hereinafter referred to as the “Lucky Draw”) is organised by Coway (Malaysia) Sdn. Bhd. (“the Organiser”) in conjunction with Coway Run 2024 (“the Event”). All Participants of the Event that registered and purchased within the period of 10 May 2024 until 13 May 2024 will be automatically eligible to take part in the Lucky Draw subject to the Terms and Conditions herein:
30. The Participant must be 18 years old and above as of 22 September 2024 and residing in Malaysia only (“Eligible Participant”)
31. There will be ten (10) Lucky Draw winners. Each winner will receive one (1) Brooks Cash Voucher worth RM400 (referred to as the “Prize”).
32. All Prizes are given on an “as is” basis and are not exchangeable for cash, credit, or other items in part or in full.
33. The Organiser reserves the right to forfeit the Prize if the winners fail to respond to the Organiser’s message/email within five (5) days from the notification of winning, including weekends and public holidays.
34. By participating in the Lucky Draw, the Eligible Participant is deemed to have agreed and consented to the Organiser’s usage of his/her details submitted on the Coway Run Website.
35. The Organiser reserves the right to disqualify any submission of entry made without executing the proper procedure of participation.
36. The Organiser reserves the right to make any changes to the Lucky Draw at any time, without any reason whatsoever including but not limited to cancelling the Lucky Draw, replacing the Prize with another item of an equivalent value at any time it deems fit, forfeiting the Prize and altering the Terms and Conditions contained herein without prior notice.
PRIVACY POLICY
A. Introduction
1. Coway (Malaysia) Sdn. Bhd. (“Coway”, “we”, “our” or “us”) values and is committed to protecting Personal Data (as defined below). As such, in compliance with the Personal Data Protection Act 2010 (the “Act”) and our commitment towards the protection of our registrants’ personal information, we have put in place this Privacy Notice (“Notice”) specifically for our annual Coway Run event (the “Event”).
2. This Notice explains the type of Personal Data we collect or have collected; how we collect, process, store, and retain your Personal Data; and to whom we disclose or have disclosed your Personal Data as required under the Act.
3. By providing your Personal Data to us and/or continuing access to this website (www.cowayrun.com.my) (the “Coway Run Website”), you declare that you have read and understood this Notice and consent to us processing your Personal Data in the manner as set out in this Notice.
4. Kindly note that we reserve the right to amend, update and/or vary this Notice at any time and from time to time. Notification of such amendments/updates/variations shall be published on the Coway Run Website and/or other means of communication deemed suitable by Coway. Please check the Coway Run Website from time to time to stay informed of any changes to this Notice.
B. Collection of Personal Data
1. We collect and process personal data when you interact with us through the Coway Run Website, which includes without limitation:
a. your personal details, such as your name, company name, residential address, contact number, email address, date of birth, race, gender, marital status, national registration identity card number, passport number, nationality, images, and biometrics;
b. your payment details, such as your debit/credit card information, bank account details, and payment history;
c. technical information such as Internet Protocol (IP) address, browser type and version, time zone settings, browser plugin type, operating systems and platform, device information, and account login information;
d. the date(s) and time(s) you access the Coway Run Website;
e. your running statistics and data;
f. information relating to your activities, habits, preferences, and interests arising from your participation in the Event including your views or opinions made known to us via feedback or surveys;
g. any details relating to any other person(s) who may be identified from any information, data, or document you submit to us; and
h. any other personal information you provide to us in the course of your interaction with us (collectively referred to as “Personal Data”).
2. We may collect your Personal Data:
a. when you access the Coway Run Website and/or any of the other websites/online platforms (collectively, “Sites”);
b. when you ask us about the Event i.e. registration, ticket purchasing process, payment process etc. or otherwise communicate with us;
c. when you register an account on the Coway Run Website to sign up for the Event;
d. when you make payments to purchase tickets to this Event;
e. when you participate in our promotional events via the Coway Run Website and/or our official social media channels;
f. when we distribute/present the Coway Run Race Kit, contest prizes, or any other merchandise related to the Event to you;
g. when you provide us with any feedback, participate in surveys, and/or lodge a complaint with us;
h. where relevant, from third parties; and/or
i. from publicly available sources.
C. Purposes
We may use and process your Personal Data in a number of ways, including but not limited to the following purposes:
a. for the registration of an account on the Coway Run Website;
b. to create, manage, and maintain your account and your Runner Profile on the Coway Run Website;
c. to manage your participation in events and/or promotions hosted on the Coway Run Website, if you have signed up for such events and/or promotions;
d. to process payments made by you or on your behalf via our payment gateways operated by our third-party service providers;
e. to enable you to interact with other participants/registrants of the Event;
f. to provide administrative notices or communications applicable to your use of the Coway Run Website;
g. to manage and maintain our relationship with you;
h. to keep you informed of our products and/or services, promotions, discounts, and/or events;
i. to provide care and enhance customer satisfaction, including but not limited to resolving complaints, dealing with and/or responding to your requests and enquiries related to the Event;
j. to operate, evaluate, and improve our business and the products and services we offer;
k. to analyse and enhance our marketing communications and strategies;
l. for internal record keeping or other administrative purposes;
m. for statistical analysis purposes;
n. for information management and security purposes, including but not limited to managing and administrating e-mails, handling and investigating any security-related issues, vulnerabilities, and/or incidents;
o. (upon conclusion of the Event) where there are outstanding obligations either on your part or on our part;
p. to purchase Group Personal Accident Insurance (as made mandatory by the Malaysian Sports Commissioner’s Office for every public sports event);
q. to exercise any functions conferred by law and/or towards the administration of justice; and/or
r. for and/or in connection with all other purposes incidental and/or ancillary to our business/services or in furtherance to any of the above-mentioned purposes, (collectively referred to as the “Purposes”).
D. Disclosure to Third Parties
1. If and when necessary in connection with the Purposes, your Personal Data may be disclosed and/or transferred to third parties which may or may not be located outside Malaysia, including but not limited to:
a. our affiliates;
b. our employees, authorised agents or contractors and other third-party service providers who provide services to Coway for any of the Purposes mentioned in Paragraph C above;
c. our partners, vendors, and sponsors participating in the Event;
d. our external advisors, professional or otherwise, including solicitors, accountants, and auditors; and/or
e. government, quasi-government, and regulatory authorities.
2. In addition to the above, we may also disclose and transfer your Personal Data to the above third parties for the purposes of any corporate exercises involving Coway including any mergers or acquisitions.
E. Security of Personal Data
Although we endeavour to maintain appropriate technical and organisational security measures to protect the security of your Personal Data against loss, misuse, unauthorised access, disclosure, or alteration, no electronic transmission of information can be entirely secure. We cannot guarantee that the security measures we have in place are utterly and absolutely sufficient or effective to safeguard your Personal Data. As a user of the Coway Run Website, you agree to assume all responsibilities and risks in your use of the Coway Run Website and acknowledge the existence of all such risks in using the internet generally. To further protect your Personal Data, you should safeguard your username and password (registered on the Coway Run Website) and not share such information with anyone.
F. Updating your Personal Data
You may access, update, and amend the Personal Data contained in your Runner Profile at any time by logging into your account and making the necessary changes.
G. Consent, Withdrawal of Consent, and Opting Out
1. Except as otherwise provided in this Notice, we only collect Personal Data that you provide to us. If you would prefer that we do not collect Personal Data from you, please do not provide us with any such information or access the Coway Run Website. By visiting the Coway Run Website, providing Personal Data to us, or otherwise interacting with us, you shall be deemed to have read and consented to our processing of your Personal Data in the manner as described in this Notice.
2. You may withdraw your consent to our processing for any of the Purposes, at any time by contacting us via the contact details provided in paragraph J below. If we do not receive any notification from you concerning our processing of your Personal Data, we shall proceed to process the same for the Purposes as set out above, on the basis that you have consented to our current as well as all our previous processing of your Personal Data in accordance with this Notice.
3. Please note that we may not be able to process your registration for the Event and/or you may not be able to participate in the Event if you do not provide us with your consent or withdraw your consent for any of the Purposes.
4. Notwithstanding any other provisions in this Notice, you may opt out of or unsubscribe from receiving our promotional materials by clicking on the “Unsubscribe from this list” icon located at the bottom of our emails to you.
5. Where you provide us with the Personal Data of other persons or parties, you agree that you shall ensure that those persons or parties have been made aware of and given consent to this Notice.
H. Third-Party Websites
The Coway Run Website may provide links to other websites or social media platforms, including those of our partners, vendors, sponsors, advertisers, and affiliates participating in the Event. Please note that we are not responsible for those websites or social media platforms. If you link to or otherwise visit any other sites, please review the privacy policies posted on those sites.
I. Web Browser Cookies
1. The Coway Run Website may use cookies to enhance the experience of our users. A cookie is an element of data that can be sent to your browser. Your browser may then store it on your system based on the preferences you have set on your browser. Cookies gather information about your operating system including, but not limited to, browser type and Internet Protocol (IP) address. The Coway Run Website uses this information to analyse traffic and better serve you when you return to our Coway Run Website. It is not our intention to use such information to personally identify a user.
2. You have the option to configure your Internet browser to notify you when you receive a cookie, giving you the chance to decide whether or not to accept it. Furthermore, you have the option to block all cookies. However, please note that if you refuse or otherwise block cookies, you may not be able to use all of the functions available on the Coway Run Website.
